Calculating the Duration of Maternity and Parental Leave
Calculates the duration of maternity and parental leave.
- Prenatal Leave
- Labor Standards Act (※1): in principle, prenatal leave is based on the expected date of natural delivery, running from 42 days before that date through the date of birth. (Administrative notice: April 2, Showa 26, Fuhatsu No. 113.) For multiple births, 42 days becomes 98 days. Public employees can start maternity leave 2 weeks earlier.
- Some companies allow prenatal leave to begin earlier than 42 days before delivery, beyond the legal provisions, so check with your company. If a doctor has scheduled a caesarean delivery in advance, that scheduled date is often used as the reference date.
- Health insurance maternity allowance: the prenatal leave period is based on the date of birth (or the expected due date if birth occurs later than expected), running from 42 days before that date through the birth date. See Calculation of Lump-Sum Childbirth Allowance, Maternity Allowance, and Childcare Leave Benefits for details.
- Postnatal Leave
- 56 days starting the day after childbirth.
- Childcare Leave Period
- In principle, leave lasts until the day before the child’s 1st birthday. If both parents take childcare leave, the Papa-Mama Childcare Leave Plus scheme allows leave until the child is 1 year and 2 months old. If specified conditions apply, such as being unable to secure a nursery place, leave can be extended up to 2 years.
- Childcare Leave Immediately After Birth
- In principle, childcare leave immediately after birth (commonly called postnatal paternity leave) is available to male and female workers who are caring for a child within 8 weeks of birth and are not on postnatal leave. Within those 8 weeks, workers may request up to 4 weeks (28 days), divided into no more than 2 periods.
